A decision was recently issued by the Federal Circuit in Aerotel v. Telco (Docket No. 2010-1515), in which the Federal Circuit affirmed the judgment of non-infringement in favor of our client, Telco Group, Inc.  A copy of the decision is attached. The firm represented Telco in this action since it was filed in 2004.  In this case, Plaintiff brought an action for infringement of a patent relating to a system and method for making prepaid telephone calls, and sought damages from Telco in the tens of millions of dollars.  After a claim construction hearing, the District Court construed all claims in favor Telco.  After consenting to entry of judgment in Telco’s favor, Aerotel then appealed the district court’s claim construction as to one claim only.  The Federal Circuit affirmed the portion of the claim construction which supported the judgment of non-infringement by Telco.  Also attached is an article appearing in IP360 today which  reports the decision.  The appeal was argued by Robert T. Maldonado with William E. Pelton and Tonia A. Sayour assisting on the briefs.
